Renewal of Trademark Registration in India
With trademark registration, a company's brand
name, which serves as its identity for selling
goods and services, can be established. Because
that is how a brand identifies itself, potential
buyers can tell one company from another.
Trademark registration in India grants the
company the rights to its brand name and
goodwill. Regardless, a TM Registration must be
issued and valid for a set period of time. This
page discusses the label renewal process, its
criteria, and the TM renewal time frame in
India. Trademark Trademarks are graphically
depicted marks that aid in identifying the
company or individual who created the goods or
services. These trademarks can be registered with
the Trademark Registry Offices under the
Trademark Act of 1999. A trademark is only valid
for ten years after it is registered. After that,
it can be renewed on a regular basis. Trademark
renewal protects the rights that can only be
obtained through a registered mark. If the owner
of the trademark fails to renew it, he will lose
all of the benefits that come with registration.
A registered brand, for example, benefits from
the legal presumption of ownership. That means
that others have the burden of proof in
attempting to refute your ownership. Why should
you need to think about the Renewal of Trademarks
in India? Renewal of a trademark has numerous
advantages. When a trademark is registered, it
grants the owner of the trademark a slew of
legal rights. It prohibits trademark infringement
and provides for reimbursement in the event of
such infringement. It also gives the trademark
holder the ability to freely transfer the
trademark to another person or company.
Trademark licencing is only feasible if the
trademark holder has registered the trademark,
hence a registered trademark has a high monetary

office informs the trademark owner that the
registration of the trademark must be updated
within 6 months of the expiration date to avoid
the owner having to deal with the unnecessary
inconveniences connected with late filing of the
trademark renewal application.

you renew a trademark? When the trademark owner
fails to answer to the Trademark Registrar's
Office's letter, the trademark owner is sent a
notice stating that the mark will be withdrawn
from the Trademark Journal if the owner does not
renew on time. A trademark is only valid for ten
years after it is registered. After that, it can
be renewed on a regular basis. Trademark renewal
protects the rights that can only be obtained
through a registered mark. If the owner of the
trademark fails to renew it, he will lose all of
the benefits that come with registration. A
trademark renewal application can be filed with
the Registrar in a prescribed form on or before
6 months before the registration expires,
together with the required renewal cost. A
renewal request, with the required late renewal
payments, can be submitted within 6 months of
the renewal date's expiration. The trademark may
be withdrawn from the Register if the request is
not filed and the fees are not paid within the
aforementioned time frames. In India, how do you
reinstate a trademark? If more than six (6)
months have passed since the renewal date and no
renewal request has been submitted, an
application for restoration must be submitted
within one (1) year of the renewal date's
expiration. The application must be supported by
the required fee as well as a statement
explaining why the trademark was not
recovered. If the Registrar is convinced that it
is just to do so, the Trademark will be restored.
