    Philadelphia, there has been a decrease in DUI
    cases over the years, as more cases are recorded
    in rural counties than in urban areas in

First-time offenders
  • Individuals categorized as first-time offenders
    are those without any prior DUI record
    convictions within the past ten years. A first
    time offender with a BAC of at least 0.08 and
    0.1 ultimately qualifies for a misdemeanor.
    Although the individual will not get their
    license canceled or suspended, they will face
    fines of up to 300. First-time offenders also
    face six months in probation, or jail depending
    on the severity of the crime. The individual is
    also required to attend an alcohol safety class.

  • In case of death or impairment or damage to
    property with a BAC of more than 0.2 but less
    than 0.16, the convicted first-time offender
    driver will face 48hours to six months in jail
    plus fines of 500 to 5000 plus a suspended
    license for twelve months.
  • A first-time offender with a minor passenger
    faces the first-degree misdemeanor with 1000 in
    fines or 100 hours in community service, and five
    years in jail or five months license suspension.

Second-time offenders
  • Or second-time offenders, for individuals
    convicted with driving with DUI, the suspected
    convict can be jailed from five days to six
    months, and receive fines from 300 to 1500.
    Their vehicle license is then suspended for a
    minimum of twelve months.
  • Second-time offenders are ensured of a mandatory
    jail term of between five to ninety days in jail
    with parole.

Third-time offenders
  • Offenders for this category face ten days to two
    years in jail, with 500 to 5000 in jail fines
    with a minimum of twelve-month suspension on
    their license. The minimum jail term for these
    offenders is between ten days to one year in
    jail, depending on the BAC levels and capacity to
    cooperate in testing.

  • There are also special fines for violators who
    have a BAC of above 0.16 and refusal to submit
    to a breath test. The driver found with this case
    will most likely face 72 hours to six months jail
    term, and around 1000 to 1500 in jail fines.
    The license suspension period is for around
    twelve months, with mandatory classes in alcohol
    safety classes.

Insurance claims
  • For DUI drivers in Philadelphia, insurance
    companies often charge more to individuals who
    have multiple DUI charges and charge them more
    due to the likelihood of attaining the DUI
    charges. The insurance company also considers the
    driver liability, and therefore the policy is

    twelve to eighteen-month license suspension
    respectively

  • With extremely high DUIs, the judge may add a
    victim to the sentencing, which requires the
    offender to attend such sessions. Offenders with
    license suspension may at least complete half of
    the sentence until they are allowed to apply for
    license reinstatement. Despite all these charges,
    being convicted with a DUI gives one the option
    to redeem themselves. For instance, the court can
    dismiss the DUI charge upon successful completion
    of the program charged to the convict.
