De Facto Financial Agreement
  • The Family Law Act 1975 (FLA) allows married or
    de facto couples to enter into binding financial
    agreements about financial issues in their
    relationships.
  • In relation to a de facto relationship, binding
    financial agreements can be made before
    commencement of cohabitation, during cohabitation
    or after the end of the de facto relationship
    commonly known as a de facto separation agreement.

    couples with a means to divide property assets
    of the relationship should it breakdown.
  • A de facto binding financial agreement is a legal
    agreement between a couple who are starting,
    currently in or ending a relationship.

De Facto Relationships Asset Protection
  • Assets includes things you own and liabilities,
    which are things you owe money on. These can be
    owned individually by you or your partner,
    jointly (with another person or persons), or by a
    family trust or family company.

Property Settlement Agreement
  • If you are able to negotiate a property
    settlement agreement with your ex partner
    directly is it important that you then seek legal
    advice from an Accredited Family Lawyer regarding
    consent orders and next steps.
  • Separating couples can apply to either the Family
    Court or Federal Circuit Court for consent orders
    to be made on their behalf. Keep in mind that
    there is a time limit of 12 months for divorcing
    couples a time limit of 2 years (from the date
    of the end of the relationship) for separating de
    facto couples to make an application for property
    settlement.
