VV Minerals Asked To Re-submit The Draft Scheme

The Madras High Court addressed by Chief Justice
Sanjay Kishan Kaul and Justice TS Sivagnanam set
aside an order quashing the rejection of mining
scheme of one of the leading mining companies VV
Minerals and Transworld Garnet India. The court
noted that the order issued by the Single Bench
was bereft of any reason and did not deal with
the respective submissions of the learned counsel
for the parties.

VV Minerals India had submitted a plea to cure
the defects examined by the bureau in the draft
mining scheme. The compliances will not have to
be resubmitted and examined in accordance with
the law by the authority.

The Bureau will have to issue the returned memo
while mentioning the reasons as to what was not
complied with. The memo will then be issued to
the two companies within 14 days.

The differences were noted when the two companies
stated to have complied with the submission
guidelines of mining scheme. The Bureau denied
the compliance and raised objections on the draft
scheme submitted by VV Minerals. It further
alleged that the companies failed to remove all
defects in the draft scheme when it was
resubmitted in January 2014.

VV Minerals approached the Single Bench for
reconsideration. The court has now asked the
Bureau to issue the memo again VV Minerals to
resubmit its draft scheme.
