Misuse of Drugs Act 1971
5Misuse of Drugs Act 1971 -Section 8
A person commits an offence if Being the
occupier, or Concerned in the Management of any
premises, They allow, or suffer any of the
following activities to take place
6- The production or attempted production, or
- The supply or attempted supply of a Controlled
Drug - The smoking of Cannabis, or
- The preparation or smoking of Opium
7- To be convicted under Sect 8, the prosecution
must prove - Knowledge, actual or by closing eyes to the
obvious - Unwillingness to prevent it which can be inferred
from failure to take steps readily to prevent it.

Summary of interview with a Landlord following
discovery of cannabis cultivation on his premises
in Liverpool
31 The property was advertised to rent in the
Mersyside local paper. A Chinese family viewed
the property. A smartly dressed Chinese woman
spoke on behalf of the group. She appeared
interested in local schools and amenities. She
was also taking an interest in the electricity
supply.
32 The group arrived and left in an old small
car. They said that they were keen to move in
quickly because they were in shared accommodation
that was currently overcrowded. A total of
1,150 cash was paid as a deposit.
33 They were quiet, paid their rent on time, the
neighbours had no problem with them and they even
had a Christmas decoration up in the window.
The following 2 months rent was paid in cash
and on time. The Landlord was shocked at the
amount of damage that had been caused to his
property. He stated that he had no knowledge of
the illegal activity that was going on inside.
