HB 529

• This bill has two separate parts.
• The first protects farmers from potential local
  ordinances that might dictate agricultural
  practices
• The second protects landowners from civil
  liability in defined situations and certain
  guidelines are followed

Summary

• Will forbid any county, municipal government,
  consolidated government or other political
  subdivision of Georgia from adopting any
  ordinance, rule, regulation or resolution
  regulating crop management or animal husbandry
  practices involved in the production of
  agricultural or farm products on private
  property.

Summary

• This bill does not impair the right of any
  county, municipal government, consolidated
  government or other political subdivision of
  Georgia from issuing business licenses or making
  zoning decisions.

Summary

• Further, this bill seeks to provide landowners
  who charge admission to their lands from
  individuals 18 years of age or older for the
  purposes of hunting, fishing or other agritourism
  practices immunity from civil liability for
  injuries incurred due to the inherent risks
  associated with the agritourism, hunting or
  fishing activity. This immunity is provided only
  when the landowner's conduct does not constitute
  gross negligence or willful or wanton misconduct,
  has posted at the main point of entry to the
  property a sign with the proper warning notice
  described in 51-1-53(A) with black letters no
  smaller than 1 inch in height and the person who
  has paid admission has signed a waiver stating he
  has waived all civil liability against the
  landowner for any injuries causd by the inherent
  risks associated with agritourism, hunting or
  fishing practices.

• HB 529 protects Georgias farmers from local
  ordinances that could interfere or outright
  prevent certain agricultural practices.
• It is important that we pass necessary
  precautions, such as HB 529, to protect our
  farmers from potential restrictions.
