  • Full regulations came into force on the 16th July
    2005
  • Repealed the Special Waste Regulations 1996
  • The term special is replaced by hazardous
  • Increases the types and amounts classified as
    hazardous e.g. refrigeration equipment,
    fluorescent tubes, CRTs (TVs, computer monitors,
    not plasma screens), undepolluted ELVs,
    contaminated soil
  • POMs are not automatically hazwaste
  • Separately collected household hazardous waste is
    covered by the regulations

  • Three types of entry in the List of Wastes
  • Absolute entry - hazardous irrespective of
    concentration e.g. 13 07 01 fuel oil and diesel
  • Mirror entries dependent on whether they
    contain dangerous substances at or above
    certain threshholds
  • 06 05 02 sludges from on-site effluent treatment
    containing dangerous substances
  • 06 05 03 sludges from on-site effluent treatment
    other than those mentioned in 06 05 02
  • Non-hazardous entries 03 01 01 waste bark and
    cork

  • Producer Requirements
  • must register all hazwaste premises annually with
    the EA
  • exempt from registration if producing lt200kg p.a.
    of hazwaste but only if from certain premises
    e.g. shops/offices/designated collection
    facilities under WEEE/medical practices
  • no exemption for industrial premises
  • must not mix hazardous waste with
  • other types of haz waste i.e.different code
  • non-hazardous waste
  • any other material

  • Premises Notification
  • can be carried out by third party
  • charge varies from 18 - 28 depending on format
  • receive premises code from the EA
  • offence to remove hazwaste from unregistered
    premises
  • mobile producers must register main business
    premises

  • Standard Consignment Procedure
  • Requires up to 4 copies of consignment note in
    almost all cases only three required
  • There is no standard format
  • Requires more detailed info than S62
  • Premises Code
  • Unique consignment code based on EA coding

  • ADR information required for Dangerous Goods
    Note
  • No pre-notification requirement EA is out of the
    paper chase loop
  • Separate procedure for multiple collections

  • Standard Consignment Procedure (cont.)
  • Consignor/Producer completes Sections A B
  • Carrier completes section C
  • Consignor completes section D
  • Consignor retains one copy, gives one copy to
    producer if required
  • Carrier takes remaining two copies to Consignee
  • Consignee completes Section E, gives one copy to
    carrier, retains one copy

  • Consignees duties
  • Send quarterly return to the EA
  • The consignee will be charged by the EA for every
    load of hazardous waste accepted (5 - 19)
  • Must send quarterly return to each producer
    detailing the amounts and types of materials
    received.
  • This may include a copy of the Consignment note

  • Rejected loads
  • Consignee must state on form why rejected.
  • Carrier must inform the EA
  • Producer must find an alternate consignee
  • If not found within 5 business days, waste can be
    returned to producer
  • Further consignment note must be raised

  • Registers
  • Producer keeps consignment notes and Consignee
    returns for three years
  • Consignor must keep consigment notes for three
    years
  • Carrier must keep copy for one year
  • Consignee must keep register until permit is
    surrendered or revoked

  • Implications
  • There will be a large increase in the number of
    hazardous waste producers many of these will
    have to register with the EA
  • All hazwaste streams must be segregated from non
    haz waste and other haz waste streams e.g. paint
    tins and contaminated rags will lead to smaller
    amounts of segregated hazardous waste
  • The EA will be regularly visiting hazwaste
    producers, carriers and disposers
