Local Waiver Process
  • Education Code Section 60851(c) explains the
    waiver process in detail.
  • At the request of the students parent or
    guardian, a school principal must submit to the
    local school board a request for a waiver of the
    requirement to pass the part(s) of the CAHSEE on
    which a modification was used and the equivalent
    of a passing score was earned.

Local Waiver Process(Continued)
  • For the local board to waive the CAHSEE
    requirement, the principal must certify the pupil
    has
  • (1) An IEP or Section 504 Plan that requires the
    modifications to be provided to the pupil when
    taking the CAHSEE.
  • (2) Completion, or in the process of completion,
    of high school-level coursework sufficient to
    have attained the skills and knowledge otherwise
    needed to pass the CAHSEE.
  • (3) A score report showing that the student
    received the equivalent of a passing score on
    the CAHSEE while using a modification.

Senate Bill (SB) 517One-year Exemption
  • Chapman settlement law
  • Signed by Governor on January 30, 2006
  • Takes effect immediately
  • Repealed December 31, 2006
  • Education Code 60852.3 Students with
    disabilities who have not passed the CAHSEE, or
    who have not received the local waiver to satisfy
    the requirement to pass, are exempt in 2006, if
    they meet all the following criteria.

Exemption Criteria
  • Students with disabilities on track to graduate
    in 2006 who have an IEP or Section 504 plan dated
    July 1, 2005 or earlier
  • Attempted to test at least twice since grade 10
    once in grade 12
  • Tested using accommodations or modifications, if
    any, specified in IEP or Section 504 plan

Exemption Criteria (continued)
  • Received CAHSEE remediation or supplemental
    instruction through school, private tutor, or
    other means, and took the CAHSEE at least once
    following remediation OR if not,
  • School district or state special school indicates
    failure to provide CAHSEE remediation or
    supplemental instruction
  • Written acknowledgment by student or parent, if
    minor entitled to free appropriate public
    education

    fails to grant a diploma under Education Code
    60852.3
  • Must submit documentation to SBE within 15 days
    of determining student does not meet eligibility
    criteria
  • SBE to review by next meeting or within 30 days

Class of 2006 Update
  • As of February, 89 of the class of 2006 passed
    both parts
  • Prior to the February administration, 14,668
    students with disabilities had satisfied the
    requirement
  • Since the fall administrations, 4,694 students
    with disabilities have additionally satisfied the
    requirement
  • Cumulatively, 19,362 students with disabilities
    have satisfied the requirement

  • Focused on strengthening link between items and

NCLB Flexibility
  • NCLB allowed states additional flexibility to
    develop an alternate assessment based on modified
    achievement standards for students with
    disabilities
  • Federal regulations for standards-based tests
    based on modified achievement standards have not
    been finalized

CMA Overview
  • CMA will include
  • ELA and math for grades 2-11
  • Science for grades 5, 8, and 10
  • Intended to assess students with disabilities who
    have a higher cognitive level than CAPA but need
    assistance to access grade-level curriculum
