You See a Problem With Trademarks Here?
  • Majerovitz said Chucky Cheese employees quickly
shut down the arcade games and carried large
ziplock bags out of the kitchen and threw them in
    a dumpster in the alley.

You Can Tivo It, But Media Can't
  • According to Drudge, digital video recorder
leader TiVo is sending news organizations
cease-and-desist letters, asking them not to use
the word "Tivo" as a verb. Obviously, it cannot
keep users from using it, and I doubt the
company would want to even if it could. The
factor at play here is the trademark-law
provision that says that if a company doesn't
defend a trademark sliding into use as a verb, it
loses rights to it all together.

You Can Tivo It, But Media Can't
  • So as you pull up the ZIPPER of your SPANDEX
running suit and ride the ESCALATOR down to the
TARMAC, keep in mind that these were all
trademarks lost to the "genericized" use of the
word. Also on that list is HEROIN, formerly a
    pain reliever registered by Bayer.

Trademarks
  • From the Fredricksburg Free-Lance Star stylebook
  • Heres an abbreviated list of federally
registered trademarks and service marks. This
list is adapted from one prepared by Columbia
Journalism Review. All copy editors and news
editors have complete, current trademark lists on
    their desks.

Trademarks
  • That checklist was adapted from the International
Trademark Association's checklist of about 3,000
    registered trademarks and service marks.

  • Also, keep in mind that every media venue should
have a trademark dictionary in the newsroom.

  • (By the way, just recently, the U.S. Trademark
Trial and Appeal Board ruled that the term
"Realtor" referred exclusively to members of the
National Association of Realtors. Not everyone
who's a real estate agent is a "Realtor.")
