Yaz Lawsuit Background
Yaz was approved by the Food and Drug
Administration in 2001. In 2008, Bayer was
forced by the FDA to change its advertisements
for the drug because the ad campaign that year
did not clearly discuss the serious side effects
that the drug sometimes caused. While it did
not clearly emphasize side effects, it
overstated Yaz's approved uses, including its
use to treat acne, relieve PMS symptoms and
prevent the user from having periods.
Because of Bayer's aggressive ad campaign that
did not completely discuss Yaz's side effects,
Yaz became the highest-selling birth control pill
in 2008 and 2009. Thousands of women experienced
side effects that were so severe that they will
experience the effects on their health for the
rest of their lives. Some women even died as a
result of using Yaz because they were not made
fully aware of the side effects and behaviors
they should avoid. A Yaz lawsuit was the only
way for these women to manage the high healthcare
costs involved in managing their health
problems.
The typical Yaz lawsuit involves charges that
Bayer willfully misrepresented Yaz by
placing too much emphasis on the drug's approved
uses while not completely disclosing the
severity and risk of side effects. Bayer also
failed to indicate that the risk of some side
effects was much higher for women who smoked.
Although it paid some attention to these
problems in its ads, Bayer chose to
underemphasize them while marketing Yaz as a
miracle drug for women with a variety of
problems related to their menstrual cycles.
Yaz Cardiovascular Side Effects
Many birth control pills carry some risk of heart
problems. However, the cardiovascular side
effects that Yaz causes are more severe than many
of the birth control pills marketed before it.
Yaz is a synthetic estrogen that raises the
potassium levels in the body. Potassium can
cause serious heart problems if too much of it
is present. The effect that Yaz has on the body
is so extreme that even healthy young women who
should have no heart problems are advised not to
drink sports drinks or include foods high in
potassium in their diets.
Some of the cardiovascular side effects Yaz
causes are
Heart attack
Stroke
Deep vein thrombosis
2Pulmonary embolism, blockages in the main
arteries of the lungs, often caused by deep vein
thrombosis
Even some college-age women who took Yaz
experienced some of these side effects. People
who have heart attacks before the age of 35 see
drastically increased chances of having more
severe heart attacks later in life. Young
women who experienced these severe side
effects so early in their lives may have to live
with poor health because they took Yaz. Some
women even died from the cardiovascular side
effects of Yaz.
Yaz Gallbladder Symptoms
Many women also experienced gallbladder problems
caused by gallstones that formed because of Yaz.
Gallstones form in people with high
cholesterol. Estrogen, including synthetic
estrogen like Yaz, can sometimes cause
cholesterol levels to increase and cause
gallstones.
Gallstones can cause serious problems when
they lead to blockages in the digestive
system. Scientific studies concluded that Yaz
caused a 20 higher risk of gallbladder disease,
but Bayer claimed in its advertisements
that the risk was small. The complications
women who took Yaz experienced were
Pain from the gallstones
Inflammation of the gallbladder
Pancreatitis from gallstone blockage of the
pancreas.
Pancreatitis is a potentially fatal condition,
and some of the women who took Yaz died from
pancreatic illness related to gallbladder
disease.
Many women had to have their gallbladders removed
after they developed gallbladder disease from
taking Yaz. Although the gallbladder can be
safely removed, living without a gallbladder
does require lifelong habit changes to avoid
putting one's health at risk.
