PUBLIC ACT 381 of 1996
  • A County can operate an Authority on behalf of a
    municipality as long as the local unit concurs
    with the provisions of the Brownfield plan for an
    eligible property
  • Tax Capture provisions
  • Tax Increment Financing (TIF) Local and State
  • Approval from MDEQ is required if capturing
    school taxes
  • School taxes captured are revenue neutral
  • How captured taxes can be used

    communities

    Redevelopment Authority in November of 2001

  • 4700 Lapeer Road, Charter Township of Orion
  • Assessment Grants USEPA
  • 2001 - Oakland County was awarded 250,000 of
    which 175,000 was spent for environmental
    investigations on 18 projects
  • 2005 - Oakland County was awarded 400,000 of
    which 210,000 has been spent to date for
    environmental investigations on 22 projects

  • Assessment Eligibility
  • Six reputable environmental consultants were
    selected and qualified to perform the
    environmental investigations
  • Preliminary Brownfield site information form
  • Brownfield Cleanup Revolving Loan Fund (BCRLF)
  • 2002 - Oakland County was awarded 1,000,000 of
    which 700,000 was loaned to the Dutton Corporate
    Centre to help finance their methane collection
    system for the Former Sanicem Landfill
  • 2004 - Oakland County was awarded 395,000 which
    when combined with the first BCRLF grant created
    an additional loan for 440,000 that may be
    awarded to a local CVT and/or a private developer

    Charter Township of Orion and the City of Auburn
    Hills
  • 10 Million clean-up

  • 150-200 Million overall investment

  • The Charter Township of Orion just approved site
    plans for a 4 story hotel, 2 restaurants and a
    bank for a portion of the 40 acres located within
    their Township

Oakland Brownfield Initiative Brownfield Project
Flow Chart
Local Host Committee is created. The committee
shall consist of a minimum of one or more of the
Directors of the OCBRA, as well as one elected
official, or his/her designee from the affected
city.
  • Submission of the Projects Brownfield Plan, as
    well as all environmental investigation work
    completed.
  • One Week before OCBRA meeting.

OCBRA meeting to discuss, and vote on the
Projects Brownfield plan.
  • Local City Meeting to Discuss and Vote on
    Projects Brownfield Plan
  • Must occur before the Oakland County Planning
    Building Vote.

Oakland County Planning Building committee
Meeting to recommend a Public hearing by the
Oakland County Board of Commissioners
  • Oakland County Board of Commissioners meeting to
    establish a Public Hearing for the Brownfield
    project.
  • Publish notices of Public hearing no less than 20
    days before hearing

Planning Building committee meeting to
discuss, and vote on the Projects Brownfield plan.
Board of Commissioners meeting to refer the
Brownfield plan to the Oakland County Finance
Committee.
Oakland County Finance Committee meets to
discuss Project, and to create a fiscal note.
Board of Commissioners meeting to discuss, and
vote on the Projects Brownfield plan.
Projects Brownfield plan is forwarded to the
State for their approval.
