80At the recent meeting of UNESCO's World Heritage
Committee in Christchurch, New Zealand, the
Committee recognized that "the Sacred Site of the
Temple of Preah Vihear is of great international
significance and has Outstanding Universal Value"
and agreed "in principle" that the temple should
be inscribed in the World Heritage List. The
Committee also requested that Cambodia strengthen
conservation and management at the site by
"making progress in developing an appropriate
management plan, which progress will enable its
formal inscription by the Committee at its 32nd
Session in 2008."
81The U.S. fully supports the inscription of Preah
Vihear on the World Heritage List, and at the
request of the Cambodian government, U.S.
Ambassador Joseph A. Mussomeli recently traveled
to Preah Vihear, along with a representative of
the U.S. State Department's Cultural Heritage
Center and other Embassy officials, to try to
determine how the U.S. Government might be able
to support the Royal Government of Cambodia in
its efforts to develop a management plan for
Preah Vihear. During the visit, Ambassador
Mussomeli expressed his appreciation for the
exceptional nature of the site and pledged to
discuss Preah Vihear with other U.S. Government
representatives during an upcoming trip to
Washington.

quíl est possible den retracer lhistoire
complexe. Le bien proposé pour inscription
comprend tous les éléments qui expriment les
valeurs du bien. Certaines parties, tel le
sanctuaire, se sont effondrées à cause de
phénomènes naturels, en particulier lérosion par
leau, mais larchitecture a conservé toutes ses
caractéristiques dorigine. Le panorama naturel
que les ermites contemplaient il ya 1000 ans na
pas changé. - Le bien est sans changement et les conditions
dintégrité sont remplies. - Authenticité
154- Lévolution des bâtiments et des techniques
utilisées pour leur construction se réflète dans
les matériaux utilisés-bois,puis le grès, la
brique et la latérite.Aucune restauration
daucune sorte na été effectuée à Preah Vihear
depuis les travaux de dégagement effectués par
Henri Parmentier en 1929-1930. - Lauthenticité est intacte.
- Justification de la valeur universelle
exceptionnelle - Le bien est dune valeur universelle
exceptionnelle pour les raisons suivantes - - Le site sacré du Temple de Preah Vihear se
distingue par son environnement naturel
exceptionnel qui est difficile daccès et éloigné
des axes principaux de circulation. Ce qui a
permis sa conservation naturelle jusqu à nos
jours.
155- Cet emsemble sacré est un exemple rare de
relation étroite entre un monument et son
environement. Au IXème siècle, cétait un
ermitage qui occupait les grottes dune falaise
abrupte de 500m donnant sur la plaine du
Cambodge. A partir du début du XIème
siècle,époque à laquelle il devint un temple
royal jusquau XIIème siècle au moins , il se
développa progressivement en une longue série de
sanctuaires reliés par plus de 800m descaliers
et de chaussées.
156- Lensemble de Preah Vihear est exceptionnel pour

considère quun bien a une valeur universelle
exceptionnelle si ce bien répond au moins à lun
des critères suivants. En conséquence, les biens
proposés doivent (i) représenter un
chef-doeuvre du génie créateur humain(ii)
témoigner dun échange dinfluences considérable
pendant une période donnée ou dans une aire
culturelle déterminée, sur le développement de
larchitecture ou de la technologie, des arts
monumentaux, de la planification des villes ou de
la création de paysages(iii) apporter un
témoignage unique ou du moins exceptionnel sur
une tradition culturelle ou une civilisation
vivante ou disparue
158- (iv) offrir un exemple éminent dun type de
construction ou densemble architectural ou
technologique ou de paysage illustrant une
période ou des périodes significative(s) de
lhistoire humaine - (v) être un exemple éminent détablissement
humain traditionnel, de lutilisation
traditionnelle du territoire ou de la mer, qui
soit représentatif dune culture ( ou de cultures
), ou de lintéraction humaine avec
lenvironnement, spécialement quand celui-ci est
devenu vulnérable sous limpact dune mutation
irréversible - (vi ) être directement ou matériellement
associé à des évennements ou des traditions
vivantes, des idées, des croyances ou des oeuvres
artistiques et littéraires ayant une
signification universelle exceptionnelle ( le
comité considère que ce critère doit de
préférence être utilisé conjointement avec
dautres critères )
159- Critères selon lesquels linscription est
proposée i, ii et iv - (i) représenter un chef-doeuvre du génie
créateur humain critère I sur la base
du fait que le temple de Preah Vihear est un
emsemble architectural unique constitué dune
serie de sanctuaires reliés par un système de
voies pavées et descaliers répartis sur un axe
denviron 800m de long. - Le site du temple et son environnement
aujourdhui un exemple particulièrement important
du génie khmer en matière dadaptation des
monuments à leur environnement. -
- Du génie khmer en ce qui concerne la
domestication de vastes territoires et
ladaptation au paysage. Le bien offre aux
visiteurs un point de vue de près de 360 degrés
sur le paysage magnifique de la plaine en
contrebas.Le Preah Vihear est un chef-doeuvre
exceptionnel de larchitecture khmère, tant son
plan que son ornementation, qui sont très purs
.
160- (ii) témoigner dun échange dinfluences
considérable pendant une période donnée ou dans
une aire culturelle déterminée, sur le
développement de larchitecture ou de la
technologie, des arts monumentaux, de la
planification des villes ou de la création de
paysages - (iii) apporter un témoignage unique ou du
moins exceptionnel sur une tradition culturelle
ou une civilisation vivante ou disparue - Critère iii Létat partie justifie ce critère
sur la base du fait que le promontoire dominant
la plaine est un témoignage exceptionnel des
traditions culturelles des ermitages. Les grottes
de cette falaise permirent aux ermites de
sinstaller à cet endroit. Leur présence suscita
la fondation dun sanctuaire sur le promontoire
au début du xième siècle, à partir duquel sest
développé lensemble sacré visible aujourdhui.
161- Cet ensemble témoigne de manière exceptionnelle
de la capacité de la civilisation khmère à
utiliser dun site difficile comme site
dinstallation et comme source de matériaux. - De même PV témoigne dun échange important de
valeurs humaines et des développements dans les
domaines des arts, de larchitecture, de
lurbanisme et de laménagement du paysage.
162- (iv) offrir un exemple éminent dun type de
construction ou densemble architectural ou
technologique ou de paysage illustrant une
période ou des périodes significative(s) de
lhistoire humaine - Critère iv LEtat partie justifie ce critère
sur la base du fait que lensemble de PV est
constitué du temple et de son environnement
associé un pasage naturel qui est exceptionnel
en raison de sa topographie et du point de vue
sans limite quil offre sur la plaine
cambodgienne.Quelque soit le point daccès ou le
point de vue adopté, le temple paraît
indissociablement lié à la falaise sur laquelle
il se dresse et dont il est lexpression.
163- Le bien doit être envisagé selon les différents
niveaux de ses éléments le temple, son
ornementation délicatement sculptée de motifs
végétaux et de mythologie classique, la
disposition du promontoire, la falaise et ses
profils et le panorama de la plaine. Lensemble
architectural est exceptionnel par sa
représentation de la géométrie bouddhiste et son
feng shui. Limplantation du temple au bord dune
falaise est particulièrement importante.Les
escaliers et les accès historiques témoignent de
plus de 1000 ans dune expérience technologique
sophistiquée.Lensemble de la structure
historique démontre lapogée dune phase
importante de lhistoire de lhumanité. -
- LICOMOS considère la valeur universelle
exceptionnelle a été démontrée et que le bien
proposé répond aux critèrea i, iii et iv.

170A- REQUEST FOR INSCRIPTION OF THE SACRED SITE OF
THE TEMPLE OF PREAH VIHEAR IN THE UNESCO WORLD
HERITAGE LIST.
171I Background 1- The Sacred Site of the Temple
of Preah Vihear was built in the 9th -12th
centuries by successive Khmer kings. 2- The
monument is situated on a romontory of Dangrek
range (northern part of modern border between
Cambodia and Thailand), 547m above the Cambodian
plain.
172- 3- Characteristics
- The Site of Angkor is a series of cities
symbolizing the apogee of the civilization of
which it was the capital from the 9th to 14th
century. - The Sacred Site of the Temple of Preah Vihear
-
- - Differs from the Site of Angkor by virtue of
way in which it is inextricably linked to its
landscape.
173- Testifies the Khmer period for domesticating
vast territories and adapting to landscape
offering the visitor of magnificent 360 view of
the plain below (ICOMOS) - Has an axial plan of
500 meters long with gopuras (gateway towers) and
streets succeed one another on the way to the
temple.
174- II - Inscription Process
- 1- Started in 2001
- 2- Based on Outstanding Universal
Value of the Sacred Site of the Temple of Preah
Vihear, the UNESCO World Heritage Committee at
its 31st session has - Agreed in principle that the Sacred Site of the
Temple of Preah Vihear should be inscribed on the
World Heritage list. - Noted that the process for inscription is in
progress.
175- Requested the State Party of Cambodia to
strengthen conservation and management at the
site by making progress in developing an
appropriate management plan leading to its formal
inscription by the committee at its 32nd session
in 2008. -
- Requested the State Party of Cambodia to submit a
progress report to the World Heritage Centre by
1st February 2008.
176- 3. The Decision 31 COM 8.24 REV Preah Vihear also
includes the Chairpersons statement emphasizing
that - This decision means that the committee has
agreed that the Sacred Site deserves to be
included in the World Heritage List. - Its formal listing will take place at its next
session in 2008.
177- B- REASONS TO DISCARD THAI CLAIMS
-
- I Non-existent Border Dispute
- The World Heritage Committee of UNESCO is a
forum of culture and not a forum to resolve
border issue claims. The 31st WHC meeting in
Christchurch rightly rejected the inclusion of
this issue in its discussion agenda.Consequently,
this border issue is irrelevant. -
- Thailand, in its attempt to block the inscription
of the Sacred Site of the Temple of Preah Vihear,
has produced a UNILATERAL map (by the Royal Thai
Survey Department) in lobbying different
countries to rally theirsupports.
178- Thailand openly does not contest the sovereignty
of Cambodia over the Sacred Site of the Temple of
Preah Vihear. Yet, Thailand continues to raise
the non-existent - border dispute between the two countries. It is
important to note that Article 11.3 of the
Convention Concerning the Protection of the World
Cultural and Natural Heritage stipulates that a
property claimed by more - than one State can be inscribed on the WHC List.
179It is very unfortunate that Thailand keeps its
attempt to object the inscription of the Sacred
Site of the Temple of Preah Vihear,
internationally recognized as part and parcel of
Cambodia. This action is in contradiction to a.
the Annex 1 Map of the ICJ,which is
internationally known as Dangrek Map. This map is
an integral part of ICJ decision on 15June
1962 b. Memorandum of Understanding between
Cambodia and Thailand on the survey and
demarcation of the land boundary (14 June 2000)
and c. Terms of Reference and master plan for the
joint survey and demarcation of land boundary (23
March 2003).
180II The Issue of Transboundary Inscription
There are many examples of a property under
the sovereignty of two different States being
inscribed separately on the World Heritage list.
Some of those are 1- Capital Cities and Tombs
of the Ancient Koguryo Kingdom (China and North
Korea). 2- Iguazu National Park (Argentina and
Brazil). 3- Belfris Towers (France and Belgium).
181 Cambodias request to inscribe the Sacred Site
of the Temple of Preah Vihear is legitimate as
the monument is situated, according to the
decision of the ICJ on 15 June 1962, in the
territory under the sovereignty of Cambodia. This
inscription is a long process while the Sacred
Site needs urgent restoration work. We are at the
final stage of inscription. On the hand, if
Thailand wishes to inscribe its property (ies) in
line with the criteria of the World Heritage
Committee, Cambodia is ready to support it.
182- III Judgment of International Court of Justice
(ICJ) - Following Thais illegal occupation of the
Temple of - Preah Vihear in 1954, the ICJ decided on 15 June
1962 to award theTemple of Preah Vihear to
Cambodia. - ? ICJ statute
- the judgment is final and without appeal
(Article 60). - no application for revision may be made after
the lapse of ten years from the date of judgment
(Article 61.5) - UN Charter Each member of the United Nations
undertakes to comply with the decision of the ICJ
in any case to which it is a party (Article
94.1) - Thailands utilization of its NILATERAL map is
in - grossviolation of the ICJs judgment.
183C. PROGRESS MADE AFTER CHRISTCHURCH MEETING, NEW
ZEALAND I. Progress of Management Plan
After the Christchurch meeting, the State
Party of Cambodia has made efforts to comply with
the recommendations of the WHCs decision 31 COM
8.24 REV on 28 June 2007 in Christchurch. The
following activities have been taken -
Different missions to the Sacred Site of the
Temple of Preah Vihear to conduct field survey by
eminent experts from Belgium, China, France,
India, Japan, Thailand, and the United States
between September 2007 and early January 2008.
184- - Active participation from 16 countries and
national and international institutions on
elaboration of the progress report, an
unprecedented numbers in the management plan
process of any World Heritage Property, which
shows strong international solidarity and
interest on the - importance of this inscription.
- At Cambodias invitation, Ambassadors, senior
level officials and experts from some friendly
countries participated in a high level mission to
the Sacred Site of the Temple of Preah Vihear on
26 November 2007.
185- As a result, a progress report on the management
plan was elaborated by involved experts in a
meeting in Siem Reap on 11-13 January 2008 and
presented to the Royal Government of Cambodia,
foreign diplomats and representatives of
interested countries in Phnom Penh on 14 January
2008. - - This progress report will be handed over by the
special envoy of the Royal Government of Cambodia
to the World Heritage Centre,UNESCO, Paris,
before the - deadline of 1 February 2008.
186II. Good Cooperation with Thailand After
the Christchurch meeting,the close bilateral
cooperation between the State Party of Cambodia
and the State Party of Thailand has been further
promoted in the following areas - Exchange of
letters between the two Prime Ministers on
present and future cooperation between the two
Kingdoms in a spirit of good neighborliness.
187- Visit in Phnom Penh on 16 August 2007, by Thai
delegation headed by Dr. Manaspas Xuto at the
invitation of the Royal Government of Cambodia
for a meeting with Cambodian delegation headed by
H.E. Mr. Sok An, Deputy Prime Minister, Minister
in charge of the Office of the Council of
Ministers. At the end, a record of meeting on
mutual cooperation with the following points was
concluded 1- The two sides agreed that
Cambodia will send students or experts to
Thailand for training. 2- The two sides agreed
that Thailand will provide information to
Cambodia concerning their experts so that
Cambodia can coordinate the participation of the
experts tobe sent by other friendly countries.
1883- By invitation from Cambodia, Thailand agreed
to be member of the International Committee for
Coordination that will be created for the
preservation and sustainable development of the
Sacred Site of the Temple of Preah Vihear. 4-
The two sides agreed that the physical works of
restoration of the Sacred Site of the Temple of
Preah Vihear will be undertaken within the
framework of international cooperation and after
the inscription.
189- Field work by Thai experts to the Sacred Site of
the Temple of Preah Vihear with full cooperation
from the National Authority for Preah Vihear on
03-04 January 2008. - Participation by H.E. Dr. Viraphand Vacharathit,
Ambassador of the Kingdom of Thailand to Cambodia
in the visit of a high level delegation to the
Sacred Site of the Temple of Preah Vihear on 27
November 2007. - At the invitation of the State Party of
Cambodia, Thai experts joined actively in the
meeting of technical working session in Siem Reap
on 11-13 January 2008 and representatives of the
Royal Thai Embassy in Phnom Penh and experts also
participated in the closing session of synthesis
report on the management plan - strategy for the Sacred Site of the Temple of
Preah Vihear in Phnom Penh on 14 January 2008.
190- III. Real Progress on the Ground
- An actively functional National Authority for
Safeguarding and Protection of the Sacred Site of
the Temple of Preah Vihear has been established. - Feasibility study for access road to the Sacred
Site of the Temple of Preah Vihear from the inner
side of Cambodia has been carried out. - Mine clearance, marking and survey activities
have been conducted by the Cambodian Mine Action
Centre (CMAC) and Halo Trust. - Illegal logging and land grabbing activities in
the protected areas have been combated by the
Royal Government of Cambodia, resulting in a
recent criminal case brought before the court.
