Gasoline-Powered Mini-Motorcycles Pocket Bikes
A gasoline-powered mini-motorcycle is a
"motor-driven cycle" pursuant to Section 405 CA
Vehicle Code with a motor with less than 150
cubic centimeters. As such, it is subject to all
vehicle equipment, registration, driver license
(M1 endorsement), and helmet requirements stated
in the California Vehicle Code.

These mini-motorcycles or "pocket bikes" are not
manufactured with a conforming 17-digit vehicle
identification number (VIN), indicating the
manufacturers intended they be operated on
private property (with owner's permission) and
not for use on a highway. They cant get register
ed as a legal motor vehicle or as an off-highway
vehicle, which makes them illegal for use on the
highways or as an off-highway vehicle.

required to be registered and are street legal.
This is incorrect information. There is nothing
in the vehicle code that allows a motor-driven
cycle to be operated on the highway that is less
than 50cc's. Any motor-driven cycle less than
150cc's is required to be registered, meet the
equipment standards of a motorcycle, and the
operator must have an M1 driver license.

407.5 VC Motorized Scooter is any 2-wheeled
device that has handlebars, is designed to be
stood or sat upon by the operator, and is powered
by a motor capable of propelling the device with
or without human propulsion.

Basic Rules For Scooters
You dont need insurance, registration, or
license plates. Must be 16 years old or older.
Must not operate on a highway with a speed limit
over 25 mph unless in a class II bicycle lane.
Must wear a proper bicycle helmet.
Cant ride with passengers. Must have a brake th
at will skid on pavement.

Must have at least 1 hand on handlebars when
carrying anything. Only ride on sidewalk when en
tering/leaving driveway. Cant have handlebars h
igher than riders shoulders.
Cant leave it where it will block pedestrians.
Cant be pulled by other vehicles .

City Regulation
The city can enact laws that govern scooter use.
21225. CA Vehicle Code - This article does not
prevent local authorities, by ordinance, from
regulating the registration of motorized scooters
and the parking and operation of motorized
scooters on pedestrian or bicycle facilities, if
the regulation is not in conflict with this code.
21230. CA Vehicle Code - Notwithstanding
any other provision of law, a motorized scooter
may be operated on a bicycle path or trail or
bikeway, unless the local authority or the
governing body of a local agency having
jurisdiction over that path, trail, or bikeway
prohibits that operation by ordinance.
