The Federal System

• The Constitution divides power between the
  national and state governments.

National Powers

• The Constitution givers three types of powers to
  the national government
• Expressed Powers.
• Implied Powers.
• Inherent Powers.
• Together they are called delegated powers.

Expressed Powers

• Are directly stated in the Constitution.
• Examples
• Levy collect taxes.
• Coin Money.
• Raise an army and navy.
• Are also called enumerated powers because they
  are listed 1 18.

Implied Powers

• Are powers the national government needs to carry
  out its expressed powers.
• Basis for implied powers is the necessary and
  proper clause (elastic clause).
• Examples
• Power to draft into armed forces.
• Regulate nuclear power plants.

Inherent Powers

• Are powers the national government exercises
  because it is a national government.
• Examples
• Control immigration.
• Establish diplomatic relations

Reserved Powers

• The Constitution does not list these
  specifically. It reserves to the states powers
  not delegated to the national government nor
  prohibited to the states.
• Examples
• Regulation of public schools.
• Establishment of license requirements.

Concurrent Powers

• Are powers national and state governments both
  exercise.
• Examples
• Levy taxes.
• Establish courts.
• Enact and enforce laws.
• Spend for general welfare.

Denied Powers

• Some powers are denied to various levels of
  government.
• National government cannot
• Regulation of public schools.
• Establishment of license requirements.
• State governments cannot
• Coin money.
• Make treaties with foreign governments.

Guarantees to the States

• The Constitution requires the national
  government
• Guarantee each state a republican form of
  government.
• Protect states from invasion and domestic
  violence.
• Respect the territorial integrity of each state.

Obligation of the States

• States perform two important functions for the
  national government
• Conduct and pay for national elections.
• Ratification of a Constitutional amendment.
