18Hurricane Rita
- Many districts were forced to close because of
Hurricane Rita. Some of the districts were
granted a special waiver from the Commissioner of
Education and were not required to make up the
days they missed.

- If your district was granted the special
Hurricane Rita waiverand the days out of school
prevented the district from serving a student
with PRS CEHI you should

- Obtain a copy of the waiver letter to the
Superintendent from the Commissioner of Education
stating the dates the school could close and not
make up the time. - The letter should be copied and placed in each
students individual file that was impacted.

- In PEIMS, code each PRS CEHI student present for
the days stated in the letter. You are counting
them present because they could not be served
because the school was closed and the district
was granted permission not to make up those days.
PRS CEHI students get the same rights as the
other students.

- Write a memo to the file. The memo must state
that the student could not be served with PRS
CEHI on ltinsert datesgt because the district was
closed for Hurricane Rita. The district received
a waiver and was not required to make up the
missed days (See attached letter dated ltinsert
dategt from the Commissioner of Education).

- Place the memo and the waiver letter in the
students file so when your district is audited
the auditors have record of why the student was
coded as served and was not served.

be served collaboratively by the District
through both - programsSpecial Education and Pregnancy Related
Services.

26It is not TEA vs. SPED vs. PRS vs. Student!IT IS
A PARTNERSHIP Collaboration to serve the
Pregnant and Parenting Student and her child.
27SPED is the primary program of service and holds
the primary responsibility.

districts lead role in collaboration as long as
SPED is primary service and student is legally

conducts Contingency ARD to address students
Change in Status and potential placement

Section IV, Special Education Any student who
is placed in the special education homebound
instructional arrangement/setting
- must meet the following four criteria
- be eligible for special education and related
services as determined by an ARD committee - is expected to be confined at home or hospital
bedside for a minimum of four consecutive weeks - for medical reasons only (unless the child is 0
5 years of age) - medical condition is documented by a physician
licensed to practice in the United States. 19

32Serving Pregnant SPED Students
- Districts believe that SPED cannot serve pregnant
student because prenatal or postpartum
confinement period is not a minimum of four
consecutive weeks. - THIS IS NOT TRUE
33Serving Pregnant SPED Students
TAC 89.63(2)(A), states that SPED homebound
services can be provided to
chronically ill students who are expected to be
confined to the home or hospital for any period
of time totaling at least four weeks throughout
the school year.

- Marked for a long duration.
35Serving Pregnant SPED Students
Pregnancy is marked for a long duration. Thus,
pregnant SPED students can be placed on Homebound
for less than 4 weeks at a time because
placement is expected to exceed 4 weeks total
over the prenatal and postpartum periods of
pregnancy.
