category 3
Milk, milk-based and milk-derived products are
classified as follow
non intended for human consumption
6
Category 1
Category 1
Hormones
dioxins
products of animal origin containing residues of
environmental contaminants if such residues
exceed the permitted level
7
Category 2
Products containing residues of veterinary drugs
, if they exceed the permitted level
Ex milk with antibiotics residues
Products imported from non-member countries that
fail to comply with the requirements for their
importation in the Community
8
Category 2
ABP other than Category 1 material or Category 3
material
i.e. ABP presenting a risk of contamination with
other animal disease than BSE or scrapie
9
Category 3
animal by-products derived from the production of
products intended for human consumption
Former foodstuffs without any risk to humans or
animals
Raw milk originating from animals that do not
show clinical signs or any disease communicable
through that product to humans or animals

Approval 1774/2002?
Food
Question Can a milk-PROCESSING (food)
establishment also be approved as an ABP
establishment?
21
Answer
SANCO/10098/2006
  • If an establishment processes milk to food grade
standards, and already fulfill the processing
standards of chapter V of Annex VII, it can be
approved accordingly without the need for a
    separate ABP approval number.
  • If however, an establishment processes both food
grade milk and ingredients unfit for human
consumption, separate approval as well as
separation of processing lines is required

Article 5,2,e
In the case () of milk and colostrum
If they present no risk of spreading any
transmissible disease
It can be applied to land in accordance with this
regulation
32
Milk and colostrumCategory 2
National environmental regulations could be more
restrictive
For example
In France, its allowed under conditions - it
must be exceptional - specific measures must be
taken to avoid smells - it is recommended to mix
the milk with manure
In Belgium, its forbidden

CATEGORY 2
CATEGORY 3
Directly, unprocessed
Use in a biogas plant
Processing method 70C for 60 minutes or another
validated method
BUT
There is no risk of spreading any serious
transmissible disease
When milk and colostrum are the only material of
animal origin (or used with catering waste), the
competent authority may authorise the use of
others requirements
IF
Residues or compost are unprocessed material

CATEGORY 3 (raw material)
Directly, unprocessed

transmissible disease
When milk and colostrum are the only material of

EFSA opinions
  • 29th March 2006 The animal health risks of
feeding animals with ready-to-use dairy products
    without further treatment the provisional
measures of EC 79/2005 dont prevent the risk
from transmission of disease to farmed animals
    through the feeding.
  • 15-16 March 2006 The public health risks of
feeding farmed animals with ready-to-use dairy
    products without treatment

40
Difficulties to implement the regulation
  • Traceability
  • Several approvals on the same establishment
    (food, feed, 1774)
  • Imported products risk of transmissible
    diseases
  • .
